AGREEMENT FOR THE PROVISION OF INFORMATION AND CONSULTING SERVICES AND ESTABLISHMENT OF A SECURITY DEPOSIT
This Agreement (hereinafter — the “Offer”) constitutes a public offer of RTW AGENCY Sp. z o.o., registered under the laws of the Republic of Poland, registered office: Aleja Armii Ludowej 6 / 164, 00-571 Warszawa, Polska, NIP 7011253719, REGON 541352935, represented by the President of the Management Board Mila Kesareva, hereinafter referred to as the “Contractor”, addressed to any individual making a payment of a security deposit, hereinafter referred to as the “Client”. The Contractor and the Client are hereinafter jointly referred to as the “Parties”.
1. SUBJECT OF THE AGREEMENT
1.1. The Contractor provides the Client with information and consulting services related to the preparation and drafting of documents, including recommendation letters, references, résumés, and other materials used to present a candidate to an employer.
1.2. The Contractor carries out activities related to the pre-selection and coordination of candidates with employers and provides informational support during the employment process.
The Contractor does not guarantee employment of the Client, as the final hiring decision is made solely by the Employer.
1.3. The payment made by the Client under this Offer constitutes a security deposit (caution) paid by the Client for document preparation and confirming the seriousness of the Client’s intentions.
The deposit is not a commission, fee for employment, or remuneration for securing a job position.
2. OBLIGATIONS OF THE CONTRACTOR
2.1. The Contractor provides the Client with services related to the preparation and drafting of documents required for the coordination of a candidate with an employer, including but not limited to:
- — preparation of recommendation letters;
- — drafting of references and résumés;
- — translation and adaptation of documents to the employer’s requirements;
- — preparation of cover letters;
- — consulting support throughout the document submission and communication process with the employer.
All such services are provided under a deposit model, meaning that the Client pays a security deposit (caution), which is refundable upon successful completion of 30 calendar days of work with the approved employer without violations.
Each service is rendered under the terms of this Offer and subject to the refund conditions specified in Section 4.
2.2. The Contractor undertakes to prepare the documents in the required format and in English (unless otherwise agreed by the Parties).
2.3. The Contractor provides the completed document to the Client for independent submission to the employer. By mutual agreement, the document may be submitted directly to the employer by the Contractor.
2.4. The Contractor maintains the confidentiality of the Client’s personal data and uses it solely for the purposes of this Agreement.
2.5. Service provision is deemed to have commenced once the Contractor receives from the Client the necessary data for document preparation and begins work on the material.
2.6. The Contractor’s obligations are considered fulfilled upon delivery of the completed document to the Client or confirmation of its readiness.
3. OBLIGATIONS OF THE CLIENT
3.1. To provide accurate personal information to the Contractor, including full name, date of birth, contact details, and professional background.
3.2. To promptly confirm and update provided information when changes occur.
3.3. To follow the Contractor’s instructions necessary for the proper preparation and submission of documents.
3.4. To review the terms of this Offer, the Deposit Refund Rules, and the Privacy Policy before making payment.
3.5. By paying the deposit, the Client confirms full acceptance of all the terms of this Offer.
4. SECURITY DEPOSIT
4.1. The payment made under this Agreement constitutes a security deposit (caution) paid by the Client for document preparation and confirming the seriousness of the Client’s intentions.
4.2. The deposit is not a commission, an employment fee, or a guarantee of hiring.
4.3. The deposit shall be refunded to the Client after thirty (30) calendar days of actual work with the approved employer, provided there are no breaches of internal company rules and upon the Contractor’s confirmation of the Client’s successful employment status.
4.4. The refund is made using the same payment method within five (5) business days after confirmation of eligibility for refund.
4.5. The deposit may be retained if the Client:
- — withdraws from employment after employer confirmation;
- — fails to start work without valid reason;
- — violates labor discipline or the employer’s internal regulations resulting in termination or sanctions.
4.6. If the employer postpones the start date, changes working conditions, or cancels the offer for reasons not related to the quality of documents or the Contractor’s actions, the deposit is non-refundable, as the Contractor’s obligations are deemed fulfilled upon preparation and delivery of the documents to the Client or the employer.
4.7. If the employer requests additional documents (such as a recommendation letter, reference, résumé, translation, certificate, or other materials), the Client may order them separately from the Contractor. Such requests do not constitute evidence of improper performance and cannot serve as grounds for refund, as employer requirements may change during the candidate evaluation process.
5. AGREEMENT ACCEPTANCE AND COMMENCEMENT OF SERVICES
5.1. This Agreement constitutes a public offer and is deemed concluded once the Client makes payment of the security deposit via the Contractor’s official payment channels.
5.2. Payment of the deposit signifies full and unconditional acceptance of the terms of this Offer.
5.3. Service provision is considered to begin once the Contractor receives the Client’s data required for document preparation or starts drafting the document.
5.4. Before making a payment, the Client confirms their agreement with the terms of this Offer, the Rules for the Refund of the Security Deposit, and the Privacy Policy by selecting the appropriate checkboxes in the online form or by any other method confirming awareness and consent, including but not limited to:
- — making a payment using the Contractor’s payment details indicated on the official website, in an invoice, or provided by the Contractor’s representative in official correspondence (messenger apps, e-mail, etc.);
- — sending written confirmation of the intention to make a payment, including messages sent via messenger apps, e-mail, or other communication channels used for official correspondence with the Contractor’s representative.
The Client’s payment using the provided details, regardless of the method of transmission (via the website, invoice, or correspondence), constitutes full and unconditional acceptance of the terms of this Offer.
The expression of consent and the subsequent payment are recorded by the Contractor’s document management system (including correspondence) and constitute sufficient proof of acceptance of this Agreement.
6. PERSONAL DATA PROCESSING
6.1. The Client grants consent for the Contractor to process personal data for the purposes of fulfilling this Agreement.
6.2. Data processing is carried out in accordance with the laws of the Republic of Poland and the EU General Data Protection Regulation (GDPR).
6.3. The Client has the right to withdraw consent, which results in termination of services and retention of the deposit as compensation for initiated actions.
6.4. The Contractor does not disclose personal data to third parties, except for employers and partners involved in candidate coordination.
7. LIABILITY OF THE PARTIES
7.1. The Contractor is not liable for the employer’s decisions to refuse, postpone, or cancel the job offer, nor for the actions or omissions of the Client.
7.2. The Client is responsible for the accuracy of the data provided.
7.3. The Contractor provides intermediary and consulting services aimed at facilitating the employment process and coordinating communication between the Client and the employer.
The Contractor does not charge the Client any employment or job-placement fees but accepts the security deposit solely as a guarantee of performance and confirmation of the Client’s intent.
8. ELECTRONIC FORM OF THE AGREEMENT
8.1. This Agreement is concluded electronically and does not require a handwritten signature.
8.2. The fact of paying the security deposit through Stripe or any other official payment system of the Contractor, as well as by transferring funds to the bank details indicated on the official website, in an invoice, or provided by the Contractor’s representative in official correspondence (including messenger apps and e-mail), constitutes full and unconditional acceptance of this Offer and signifies the conclusion of the Agreement under the terms set forth herein.
By making a payment using any of the specified methods, the Client confirms that they have read and agree to the terms of this Offer, the Rules for the Refund of the Security Deposit, and the Privacy Policy.
8.3. The technical data recorded at the moment of submitting and paying the deposit — including but not limited to: the time and date of the operation, IP address, the Client’s e-mail address, the payment amount, the transaction identifier (ID), as well as data provided by the Client in the form or during correspondence — are stored by the Contractor for the purpose of documenting the conclusion and performance of this Agreement.
These data may be used as evidence of acceptance and fulfillment of obligations in the event of a dispute, a refund request, or an audit by payment systems, banks, or other authorized bodies. The processing and storage of these data are carried out in accordance with the Contractor’s Privacy Policy.
9. DISPUTE RESOLUTION
9.1. All disputes and disagreements shall be resolved through negotiation.
9.2. If settlement is not possible, disputes shall be referred to the court having jurisdiction over the Contractor’s registered office, in accordance with the laws of the Republic of Poland.

2. Purpose of Data Processing
Your personal data are processed for the following purposes:
- — registering and identifying the candidate in the agency’s database;
- — matching and presenting the candidate to potential employers;
- — preparing, translating, and arranging documents required for employment;
- — maintaining communication with the client and providing consulting support;
- — fulfilling obligations under the contract (public offer);
- — complying with legal and accounting requirements.
3. Categories of Processed Data
We may process the following categories of personal data:
- — name, surname, date of birth, nationality;
- — contact details (telephone number, e-mail address);
- — passport data or PESEL number;
- — information regarding education, professional experience, certificates, and references;
- — data contained in the CV or supporting documents;
- — technical data (IP address, cookies, browser language, form data submitted through the website).
4. Legal Basis for Processing
Your personal data are processed on the following legal grounds:
- — Article 6(1)(a) GDPR — consent of the data subject;
- — Article 6(1)(b) GDPR — performance of a contract or steps prior to entering into it;
- — Article 6(1)(f) GDPR — legitimate interests of the controller (such as preventing abuse, ensuring proof of service delivery, or defending against claims).
5. Data Recipients
Your personal data may be shared only with third parties directly involved in the recruitment or documentation process, including:
- — potential employers;
- — partner agencies and subcontractors (e.g., for translation, preparation, or certification of documents);
- — the payment service provider (Stripe) — only to the extent necessary to process your payment;
- — legal and accounting service providers — to fulfill statutory obligations.
All data recipients are bound by confidentiality and process data only on the basis of agreements with the controller.
6. Data Transfers Outside the EEA
Your personal data may be transferred outside the European Economic Area (EEA) — for example, to IT service providers, hosting providers, CRM systems, or payment platforms (such as Stripe).
In all such cases, an appropriate level of data protection is ensured in accordance with the EU Standard Contractual Clauses (SCCs).
7. Data Retention Period
Your personal data are retained:
- — until consent is withdrawn, if processing is based on consent;
- — or no longer than 3 years after the last interaction with you (unless a longer period is required by law).
8. Rights of the Data Subject
You have the right to:
- — obtain information about your personal data and receive a copy of such data;
- — request correction, deletion, or restriction of data processing;
- — withdraw your consent to the processing of personal data at any time, if such processing is based on consent. Withdrawal of consent does not affect processing necessary for the performance of the contract or for the company’s legitimate interests, such as documenting provided services or defending against claims;
- — request the transfer of your data to another controller (data portability).
9. Voluntary Provision of Data
Providing your personal data is voluntary, however, refusal to provide such data may make it impossible to participate in the recruitment process or to receive agency services.
10. Cookies and Analytics
The company’s website uses cookies and analytics tools (e.g., Google Analytics) to ensure the website functions properly, improve user experience, and analyze statistics. You can manage cookie preferences through your browser settings.
11. Automated Decision-Making
Your personal data are not used for automated decision-making or profiling. All decisions related to employment or cooperation are made by humans — employees of the agency and representatives of employers.

This Privacy Policy may be updated periodically.
The current version is always available on the company’s official website.
Changes become effective upon publication of the updated version.
